Abstract
This comment makes a criticism of the labor jurisprudence related to the termination of the work contract of the non-teaching staff of the municipal sector governed by Law N° 19.464, for health reasons incompatible with the performance of the position. Specifically, the ruling issued by the 2° Labor Court of Santiago, in the case of Rit T-786-2016, and the rulings of the Court of Appeals of Santiago and the Supreme Court of Justice, which ruled about the case under study.References
