Abstract
This paper analyzes the judicial recognition of the social function as a limit to the right of property, with reference to the judgment delivered by the Court of Appeals of Rancagua on June 4, 2024, in Civil Case No. 574-2023. In that decision, the court upheld the ruling of the court of first instance and rejected the claim filed against Exempt Resolution No. 523 of 2019, issued by the Regional Ministerial Secretariat (SEREMI) of National Assets of the O'Higgins Region, which complemented Exempt Resolution No. 5 of 1984, thereby authorizing vehicular access -and not only pedestrian access- to the beach adjacent to the claimant’s property.
