Abstract

The Supreme Court has consistently ruled that, when a judicial claim is filed against an administrative decision issued by the Chilean Environmental Protection Agency, in accordance with Article 56 of Law No. 20,417, the legal nature of the judicial decision on such claim does not depend on its classification under Article 158 of the Code of Civil Procedure, but rather on whether the administrative act initially challenged is itself a purely procedural act or the final administrative act. In doing so, it weakens judicial oversight over administrative action and blurs the boundaries between administrative procedure and judicial review.
