Abstract

The following text pretends to ilustrate how the Supreme Court of Justice carries out -throughout a sentence that deals with a contractual breach in financial services- an implicit call to the regulation of the theory of unpredictability in Chile, in order to bring material justice to our contract Law and therefore regulate a latente reality in our country: the impossibility of continuing with de fulfillment of obligations due to an excessive unforeseen burden.
